And he fears his identity will be stolen in the process. \u201cIt\u2019s wrong,\u201d Platt said. \u201cIt\u2019s just wrong.\u201d<\/p>\n<p>Here\u2019s the situation:\u00a0When his hard drive crashed, David sent the disk away for recovery. The company recovered some files but none of the ones he specifically requested.\u00a0So, David disputed the 383 dollars he had paid.\u00a0\u201cI won,\u201d he said, noting that the bank had sided with him.<\/p>\n<p>But that victory triggered an unexpected twist.<\/p>\n<p>David says the hard drive company informed him it was keeping a copy of his data\u2014including photos, e-mails, and financial records\u2014and it could sell it all to settle the payment dispute.<\/p>\n<p>\u201cI immediately thought: This is what extortion feels like,\u201d Platt said. \u201cI felt like they sent the guys with the baseball bats to my house.\u201d<br \/>\nSecure Data Rescue pointed David to its \u201cterms and conditions,\u201d which customers must agree to. The second to last paragraph says it \u201cmay take all steps necessary, including selling the data, to recoup the costs\u201d of a dispute.\u00a0\u201cNot only is my data not really rescued, it\u2019s not really secure,\u201d Platt said. \u201cSo, Secure Data Rescue is nothing.\u201d<\/p>\n<p>David fears a corrupt buyer could steal his identity. And so did we. So, we contacted \u201cSecure Data Rescue\u201d in Georgia.<\/p>\n<p>Co-owner Matthew Rice defended his company\u2019s contract as necessary to combat fraud. Rice said he\u2019s never actually sold anyone\u2019s data, but he also refused to return or delete David\u2019s data.\u00a0\u201cIt\u2019s our data, we can do with it as we please,\u201d Rice said by phone.<\/p>\n<p>\u201cWhen this company threatens to sell your data, it\u2019s basically like holding you hostage,\u201d said Anna Han, a professor of law at Santa Clara University.\u00a0Han reviewed the Secure Data Rescue contract. She noted how one paragraph \u201cguarantees not to disclose\u201d data to third parties, yet another authorizes \u201cselling the data.\u201d\u00a0\u201cThey are completely at odds,\u201d Han said.<\/p>\n<p>Next, we visited a long-standing data recovery company for their reaction to the possible sale of David Platt\u2019s data.<\/p>\n<p>\u201cThat just shocked me,\u201d said Scott Moyer, President of DriveSavers in Novato.\u00a0The firm told us data recovery companies do generally hold customer data, but only briefly\u2014in case of shipping trouble. The company insisted they have no right to sell your data.\u00a0But, they complain the rules are murky because data recovery is largely unregulated. \u201cI wish there was some sort of regulation put in place that you have to go through a process to be verified,\u201d Moyer said.<\/p>\n<p>Hundreds of companies offer data recovery services online. So, how do you choose one?<\/p>\n<p>The expert recommends asking your device manufacturer and ask for a list of authorized service providers. \u201cIf it\u2019s Apple, call Apple,\u201d Moyer said. \u201cThey checked them out. They vetted them. They made sure they had the capabilities.\u201d<\/p>\n<p>As for David Platt, he feels he has a gun to his head with his data possibly up for sale. He said, \u201cWe\u2019ve got to buy it back, don\u2019t we?\u201d<br \/>\nPlatt says he\u2019s frustrated and fearful. But also motivated to share his story. \u201cI\u2019m doing this to try to tell the next person to avoid these guys,\u201d he said.<\/p>\n<p>We shared David\u2019s case with the Federal Trade Commission, which says it sues those that \u201cput consumers\u2019 personal data at unreasonable risk.\u201d The FTC encouraged David to file a formal complaint.
