{"id":1498,"date":"2013-12-09T20:31:11","date_gmt":"2013-12-09T20:31:11","guid":{"rendered":"http:\/\/ediscovery.drivesaversdatarecovery.com\/?p=561"},"modified":"2026-03-09T03:09:30","modified_gmt":"2026-03-09T10:09:30","slug":"case-study-with-ufed-physical-analyzer-investigative-team-helps-prove-a-case-for-capital-murder","status":"publish","type":"post","link":"https:\/\/drivesaversdatarecovery.com\/en-ca\/case-studies\/case-study-with-ufed-physical-analyzer-investigative-team-helps-prove-a-case-for-capital-murder\/","title":{"rendered":"Case Study: With UFED Physical Analyzer, Investigative Team Helps Prove a Case for Capital Murder"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><div class=\"vc_row wpb_row vc_row-fluid wpex-relative\"><div class=\"wpb_column vc_column_container vc_col-sm-12\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\">\n\t<div class=\"wpb_text_column wpb_content_element\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<h2>Case Snapshot<\/h2>\n<p><strong>Who:<\/strong> Law enforcement forensic examiners in Carrollton and Dallas, Texas, in cooperation with DriveSavers Digital Forensics Department in Novato, California.<\/p>\n<p><strong>What:<\/strong> Use of Cellebrite UFED Physical Analyzer to prove a murder suspect faked text messages from his victim.<\/p>\n<p><strong>Why:<\/strong> Without the evidence from the victim\u2019s badly waterlogged phone, prosecutors couldn\u2019t prove premeditated homicide.<\/p>\n<p><strong>Results:<\/strong> UFED Physical Analyzer helped establish that the victim had not recanted her rape accusation, and that her abuser lured her to her death.<\/p>\n<h2>Case<\/h2>\n<p>The destruction of evidence has become an\u00a0increasing problem for digital investigators,\u00a0who are often faced with mobile phones that\u00a0have been crushed under the wheels of\u00a0vehicles, submerged in water, and even\u00a0charred in accelerant-fueled blazes or\u00a0explosions.<\/p>\n<p>This kind of physical damage can compound\u00a0the difficulties\u00a0investigators experience in\u00a0recovering evidence stored on the devices.\u00a0Device data ports may be crushed, displays\u00a0unreadable, memory chips corroded. In one\u00a0such case, device damage was the only thing\u00a0standing in investigators\u2019 way as they sought to bring a child killer to justice.<\/p>\n<p>Shania Gray was just 16 when she was shot to\u00a0death in Carrollton, Texas in September 2012.\u00a0Prosecutors believed that her killer, Franklin\u00a0Davis, had lured her to her death. His motive:\u00a0keep her from testifying that he had raped her.<\/p>\n<p>Davis had thrown both her iPhone and his own\u00a0into two separate ponds. Police had recovered\u00a0both devices, reported a DallasNews.com\u00a0article, but Davis\u2019 device revealed text\u00a0messages, which appeared to be from Shania.\u00a0One contained an apparent confession that\u00a0stated she had lied to police about his\u00a0involvement in her rape.<\/p>\n<p>Still, prosecutors believed there was more to it\u00a0than that. The text messages tone and content\u00a0were inconsistent with other messages Shania\u00a0had sent, and although Davis\u2019 phone showed\u00a0that they had come from her number, her\u00a0wireless carrier had no record of her number\u00a0having sent them.<\/p>\n<p>To prove their case, prosecutors needed her\u00a0device. However, her iPhone was so badly\u00a0waterlogged that neither state nor federal law\u00a0enforcement forensic labs had been able to\u00a0recover its data. Prosecutors desperately\u00a0approached Apple, who referred them to a\u00a0Novato (Calif.)-based rm, DriveSavers Data\u00a0Recovery.<\/p>\n<p>\u201cWhen [Dallas County District Attorney]\u00a0Brandon Birmingham first approached us, we\u00a0didn\u2019t know whether he was looking for data\u00a0recovery, or a full forensic image,\u201d said Bob\u00a0Mehr, DriveSavers\u2019 Legal Services Advisor.\u00a0\u201cBut, based on the case details, I\u00a0recommended the forensic image.\u201d<\/p>\n<p>The iPhone arrived disassembled in multiple\u00a0pieces, owing to an earlier lab\u2019s effort. \u201cWe\u00a0thoroughly cleaned all the components and\u00a0repaired the resistors\/jumpers ,\u201d said Rene\u00a0Novoa, one of DriveSavers\u2019 Forensic Project\u00a0Managers. \u201cThen we assembled the pieces\u00a0and placed them into a known good housing.\u00a0Once connected, the device vibrated, but we\u00a0still couldn\u2019t see an image on the screen.\u201d<\/p>\n<p>Novoa then turned to UFED Physical Analyzer\u00a0to perform the extraction. \u201cI was able to obtain\u00a0a full image on the first attempt,\u201d he said.<\/p>\n<p>\u201cBecause it parsed the data so quickly, we didn\u2019t have to carve data manually; we identified the key data based on the easy access Physical Analyzer gave us to the data categories, and we were able to provide [DA Birmingham] with response within forty-eight hours of receiving the phone.\u201d<\/p>\n<p>The next step was to make sure that the Carrollton Police Department had access to the latest version of UFED Physical Analyzer so that its examiners could read the data and validate the evidence. They could, and the investigators were able to parse the victim\u2019s Facebook timeline along with the text messages.<\/p>\n<p>They found that Davis was pretending to be a man named \u201cD,\u201d and had used phone calls, text and Facebook messages to contact Shania and gain her trust. The forensic image also definitively showed that Shania had not sent the text messages, and that the message that claimed she\u2019d lied to police was a fake.<\/p>\n<p>Prosecutors ultimately were able to show that Davis used an app called FakeSMS to send himself spoofed text messages, which appeared to come from Shania. That evidence and other data proved that the murder had been premeditated, not a reckless act as the killer claimed. This meant that the state could prosecute for a capital offense.<\/p>\n<p>Following Davis\u2019 sentence, Birmingham noted that Shania had \u201chad a right to speak out about her abuse,\u201d a right that Davis tried to deny her and that ultimately, investigators\u2019 work with UFED Physical Analyzer gave her a voice.<\/p>\n<h2>About Cellebrite<\/h2>\n<p>Founded in 1999, Cellebrite is known for its technological breakthroughs in mobile forensics.
